Los editores de contenidos tradicionales, los que todavía no han adoptado y comprendido completamente la lógica de la Web, utilizan sus armas legales y su pequeño ejército de abogados para pelear, desalentar y destruir cualquier cosa que pueda interponerse en su trayectoria en el control total de sus canales de distribución. Pero, ¿funciona a favor o en contra de ellos?

John Blossom, analista y escritor sobre estrategias de contenidos de medios de comunicación, toma postura sobre estas cuestiones delicadas y explica, en palabras bastante simples, por qué los editores tradicionales necesitan dejar de utilizar las leyes de derecho de autor y el sistema jurídico para defender su territorio.
"Proporcionar valor en contexto es el verdadero valor de publicar, un concepto que está cada vez más en conflicto con los modelos de producción en masa que impulsan la producción de mucho del contenido actual protegido por derechos de autor."
El valor y razón de ser de la propiedad intelectual están siendo derrotados por un nuevo ecosistema de distribución y mercado basado en premisas e interacciones que son radicalmente opuestas a aquellas en las que se asientan los derechos de autor.
Hoy, el contenido encuentra su valor más fácilmente cuando se puede mover libremente entre sus canales de distribución naturales, emergentes, espontáneos. Y por eso, aunque es difícil de predecir, es sólo "una vez que el contenido es distribuido" que "encuentra su valor más fácilmente." Es el contexto el que hoy determina el valor del contenido, conduciendo naturalmente hacia un posible nuevo estilo de licencia de contenido automatizada, que podría apalancar el número de modelos de licencias existentes para pagar a los autores y creadores de contendidos por su trabajo.
